Terms of Use

Please note: Flohmarkt-Karte.de is operated by a sole proprietorship based in Germany. These terms of use are governed by German law (see section 11).

1. Scope and conclusion of contract

These terms of use apply to the use of the Flohmarkt-Karte.de platform (hereinafter the "Platform"). By registering an account and ticking the corresponding checkbox in the registration form, you accept these terms of use as binding. No acceptance is required for merely using the publicly accessible map views without registration.

3. Allocation of roles and disclaimer of liability

Flohmarkt-Karte.de is not the organizer of the flea markets displayed on the platform, is not a contracting party of the individual stall owners, and is not a party to any purchase transactions that take place at or in connection with a flea market. All transactions are conducted exclusively between buyers and the respective stall owners, or between users and organizers on site.

We assume no responsibility for:

• The goods, services, or content offered by stall owners or organizers
• The quality, origin, legality, or pricing of items offered
• The accuracy or completeness of event and location data entered by users
• Sales processing, payment arrangements, or disputes between buyers and sellers
• Compliance with statutory provisions (e.g. warranty, right of withdrawal, trade or tax law) by users or stall owners

Users who post content as organizers are solely responsible for the legality of that content, compliance with applicable laws and regulations, and any tax obligations arising from sales proceeds. In the event of disputes between buyers and sellers, please contact the respective stall owner or organizer directly; Flohmarkt-Karte.de cannot mediate in such matters.

This limitation of liability does not apply to damages arising from injury to life, body, or health, or to damages based on an intentional or grossly negligent breach of duty by Flohmarkt-Karte.de, and does not affect liability for breach of material contractual obligations (cardinal obligations).

4. Registration and user account

Registration is required to use certain features (e.g. creating your own flea market maps). The information provided during registration must be truthful and complete. Login credentials must be kept confidential and must not be shared with third parties. Users are responsible for all activities carried out under their account.

5. User obligations

Users undertake not to post content that violates applicable law, the rights of third parties (in particular copyright, trademark, or personality rights), or accepted principles of morality. In particular, the following are prohibited:

• Unlawful, misleading, or fraudulent content
• The advertising of prohibited or counterfeit goods
• Posting third-party content without the necessary usage rights
• Actions that impair the functionality of the platform (e.g. automated queries, malware)

6. Usage rights to posted content

Users grant Flohmarkt-Karte.de a simple right of use, limited in time to the duration of registration or publication, to the content they post (e.g. event descriptions, location data, images), insofar as this is necessary to provide the platform's features (in particular the public display of the map). Users warrant that they hold the necessary rights to the content they post.

7. Free use and donations

Use of the platform is free of charge. Operation is financed through voluntary donations, which can be processed via the payment provider made available in the dashboard. No additional claims against Flohmarkt-Karte.de arise from a donation.

8. Availability

We strive for high availability of the platform but cannot guarantee uninterrupted accessibility. Maintenance work, technical disruptions, or events beyond our control may lead to temporary restrictions.

9. Suspension and termination

We may suspend user accounts or remove content if there are concrete indications of a violation of these terms of use or applicable law. Users may request deletion of their account at any time by emailing info@flohmarkt-karte.de. For storage and deletion periods after termination, see the privacy policy.

10. Changes to these terms of use

We reserve the right to amend these terms of use as necessary, for example to adapt them to changed legal requirements or new features of the platform. Registered users will be informed of significant changes by email.

11. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions shall remain unaffected.
